For a representative or attorney to charge a fee for representing someone in a claim for disability benefits, a fee agreement is entered into, setting out the terms of a fee to be charged. In most cases, the fee agreement is based on charging a percentage of the past due benefits, once there is a finding that the claimant is approved. The fee is typically 25% of the past due benefit, and is reviewed and approved by the Social Security Administration. If the claimant is unsuccessful, no fee is charged.
